Terms of Service — TourSync

1. Eligibility

TourSync is intended for artists, managers, and industry professionals aged 18 and over. By using the App, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.

2. Description of Service

TourSync is a tour management platform that allows artists and their management teams to organise tour dates, contacts, documents, and calendar information, across web, iOS, and Android.

We may add, change, or remove features at any time, and may suspend or discontinue the App (in whole or in part) with reasonable notice where practicable.

3. Accounts

• You must provide accurate and complete information when creating an account (name, email, phone number).
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must notify us promptly at info@toursyncapp.com if you suspect unauthorised access to your account.
• You may delete your account at any time directly within the App. Deletion is immediate and permanent (see our Privacy Policy for details on data handling).

4. Subscriptions and Payment

• TourSync offers a 14-day free trial to new subscribers. No payment is taken during the trial period.
• Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan and billing will begin.
• Current subscription plans and pricing are published on our website at toursyncapp.com and are subject to change. The price and plan in effect at the time of your purchase or renewal will apply to you.
• Payments are processed securely through Stripe. TourSync does not directly store your full payment card details.
• Subscriptions renew automatically at the end of each billing cycle at the then-current price, unless cancelled before the renewal date.
• You can cancel your subscription (including during the trial) at any time within the App. Cancellation stops future billing; it does not automatically entitle you to a refund for the current billing period unless required by applicable law.
• We will provide reasonable notice of any price changes before they take effect for existing subscribers.

5. User Content

• “User Content” means any tour dates, contacts, documents, calendar data, or other material you upload or input into the App.
• You retain ownership of your User Content. You grant TourSync a limited licence to host, store, and process your User Content solely to provide and operate the App.
• You are solely responsible for the accuracy, legality, and appropriateness of your User Content, and for having the right to upload any third-party information (e.g. contact details of others) you input into the App.
• We do not claim ownership of your User Content and do not use it for any purpose beyond operating the App for you.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Upload content that is illegal, infringing, defamatory, or violates the rights of others
• Attempt to gain unauthorised access to the App, other accounts, or our systems
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law
• Use the App to send spam or unsolicited communications
• Interfere with or disrupt the App’s operation or security

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

The App, including its design, features, branding, and underlying software, is owned by TourSync and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets beyond what’s necessary to use the App as intended.

8. Termination

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your access to the App if you breach these Terms, engage in unlawful activity, or if required by law.
• Upon termination, your right to use the App ends immediately. Provisions that by their nature should survive termination (e.g. intellectual property, limitation of liability) will continue to apply.

9. Disclaimers

The App is provided “as is” and “as available.” We do not guarantee that the App will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.

TourSync is a scheduling and organisational tool. We are not responsible for the accuracy of tour, contact, or calendar information entered by users, or for any business decisions made based on it.

10. Limitation of Liability

To the fullest extent permitted by law, TourSync and its team shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, data, or business opportunities, arising from your use of (or inability to use) the App.

Our total liability for any claim relating to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. for fraud or death/personal injury caused by negligence).

11. Indemnification

You agree to indemnify and hold TourSync harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App, your User Content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the United Kingdom. TourSync is available to users worldwide; nothing here removes any statutory rights you may have under the laws of your own country.

Any disputes arising from these Terms or your use of the App will first be attempted to be resolved informally by contacting us at info@toursyncapp.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom, unless mandatory local law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
